These Terms do not exclude, restrict or replace any right or remedy that cannot lawfully be excluded under the Consumer Protection Act, 2019 or other applicable law.

These Terms of Service ("Terms") govern your access to and use of https://bckyrd.studio, its account and checkout experiences, creator storefronts, content, features and related services (together, the "Website"), and purchases made from BCKYRD STUDIO PRIVATE LIMITED ("BCKYRD", "we", "us" or "our").

By using the Website, creating an account or placing an order, you agree to the provisions that apply to that activity. If you do not agree, do not use the Website or place an order. Our Privacy Policy, product-page disclosures, order confirmation and the Exchange/Returns Policy available under Help on the Website form part of these Terms where relevant. If a product-page disclosure conflicts with these Terms for a particular product or drop, the more specific disclosure applies, subject always to applicable law.

1. Who operates the Website

The Website is operated by BCKYRD STUDIO PRIVATE LIMITED, an Indian company with registered office at Flat No. A-401, Shivgyan Vadanta, Near Airport, Malviya Nagar, Sector 11-12, Jaipur, Rajasthan 302017, India.

Unless a product page expressly identifies another seller, BCKYRD is the seller of products purchased on the Website. A creator name or storefront identifies the relevant collaboration or collection; it does not by itself make the creator the seller, payment recipient, fulfilment provider or contracting party for your purchase.

The Website is hosted on Shopify. Shopify supplies the commerce technology but is not the seller of BCKYRD products and is not a party to your purchase contract with BCKYRD.

2. Eligibility, accounts and information you provide

You must be at least 18 years old and legally capable of entering into a contract to place an order. A person under 18 may use the Website only under the supervision of a parent or legal guardian, who is responsible for the activity and any purchase.

You must provide accurate, current and complete account, billing, delivery and contact information. You are responsible for safeguarding your account credentials and for activity conducted through your account, except to the extent caused by our failure to apply reasonable security measures. Notify us promptly if you suspect unauthorised access.

We may verify order information, payment status, delivery details or suspected fraud before accepting or fulfilling an order. Do not provide another person’s information unless you are authorised to do so and the information is necessary for the transaction.

3. Products, creator drops and product information

BCKYRD offers limited-edition, creator-associated and other products that may be stocked, pre-ordered, made to order or released in time-bound drops. The product page will state the material features reasonably required for an informed purchase, which may include size, composition, care, price, taxes, availability, estimated dispatch, country of origin and manufacturer, packer or importer information where applicable.

Product images are illustrative. Screen settings, lighting and production tolerances may cause reasonable differences in colour, texture or placement. These tolerances do not reduce your rights where a product is defective, materially different from its description or otherwise non-conforming.

Availability, drop windows and quantity limits may change. We will not use false scarcity or misleading urgency. We may impose reasonable per-customer quantity limits, refuse bulk or reseller orders, or cancel duplicate, abusive or automated orders where disclosed or reasonably necessary to protect a fair release.

4. Orders and contract formation

Submitting an order is your offer to buy the products shown in your cart. An automated receipt or payment message acknowledges submission but does not itself confirm acceptance. We accept your order when we send an express acceptance or dispatch confirmation, or when we dispatch the product, whichever occurs first.

We may decline or cancel an order before acceptance for genuine reasons such as unavailability, payment failure, an obvious pricing or description error, delivery restrictions, suspected fraud, breach of quantity limits or legal restrictions. If we cancel after receiving payment, we will initiate a full refund for the cancelled amount to the original payment method within a reasonable period.

Review the item, size, quantity, address and contact details before submitting. Contact customer care promptly if you need a correction. A requested change is not effective until we confirm it, and address, size or cancellation changes may no longer be possible after production or dispatch has begun.

5. Prices, taxes, payment and fraud checks

The price payable is the amount displayed at checkout when the order is placed. The checkout will show the total product price, applicable taxes, shipping charges, discounts and other mandatory charges known to us before you confirm payment. For an international order, the recipient may also be responsible for import duty, local tax or customs charges not collected by BCKYRD, where this is disclosed before purchase or imposed by law.

Payments are processed by the payment methods and providers displayed at checkout. You authorise the relevant provider to charge the selected method. BCKYRD does not ordinarily receive or store complete card or bank credentials; we generally receive a transaction reference, payment status and limited billing information needed to manage the order.

A clearly apparent pricing or technical error does not require us to supply at the erroneous price. We will contact you for confirmation at the correct price or cancel and refund the affected order. Promotions, discount codes and credits are subject to their stated period, eligibility and limits and may not be combined unless expressly allowed.

6. Shipping, delivery and risk

Delivery destinations, charges and estimated dispatch or delivery windows are shown on the relevant product page, at checkout or in the order confirmation. Estimates are not guarantees, particularly for pre-orders, made-to-order products, remote locations, customs processing or events outside our reasonable control. We will communicate a material known delay and any remedy required by law.

You must provide a complete and serviceable delivery address and be available to receive the shipment. Reasonable re-delivery or return-to-origin costs caused by an incorrect address, refusal or repeated failed delivery may be charged where disclosed and permitted by law.

Risk of loss or damage passes to you when the product is delivered to you or a person you designate, not merely when it is handed to a carrier. If tracking shows delivery but the parcel is missing, or the parcel arrives damaged or tampered with, notify customer care without undue delay so we can investigate with the carrier. We may reasonably request the packaging, photographs, an unboxing record or other available evidence, but no single type of evidence automatically overrides a statutory consumer remedy.

7. Cancellations, exchanges, returns and refunds

Eligibility, request windows, condition requirements, exclusions and the request process are stated in the Exchange/Returns Policy available under Help on the Website and, for a special drop, on the product page. Made-to-order, personalised, hygiene-sensitive or final-sale limitations apply only where clearly disclosed and permitted by law.

Nothing in an Exchange/Returns Policy or product-page restriction limits a remedy required by law for a product that is defective, deficient, unsafe, spurious, incorrect, materially different from its description or delivered later than an expressly agreed deadline without acceptance of the delay.

Any cancellation charge must be disclosed, reasonable and applied consistently with applicable law. Approved refunds are initiated to the original payment method within a reasonable period after eligibility is confirmed; the bank or payment provider may require additional processing time. Original shipping, return shipping and reverse-pickup charges are treated as stated in the applicable policy and consumer law.

8. Product use and care

Follow the sizing, washing, care, safety and use instructions supplied on the product page, label or packaging. Normal wear, misuse, accidental damage, unauthorised alteration or failure to follow care instructions may not constitute a defect, subject to applicable law. Stop using an item and contact us if you reasonably believe it is unsafe.

9. Intellectual property and creator rights

The Website, BCKYRD name and marks, layout, text, photographs, graphics, films, audio, software, product designs, packaging and campaign materials are owned by BCKYRD or used under licence and are protected by applicable intellectual-property laws.

Creator names, stage names, images, likenesses, signatures, artworks and other project material may be owned by the relevant creator, BCKYRD or another licensor and are displayed under authorisation. A product purchase transfers ownership of the physical item only. It does not grant any right to reproduce, commercialise, mint, train a model on, create derivatives from, endorse with, or otherwise exploit BCKYRD or creator intellectual property.

You may access and use the Website for personal, non-commercial shopping and information. You may not copy, scrape, republish, frame, reverse engineer, systematically extract, commercially exploit or remove rights notices from Website content without prior written permission, except where applicable law expressly permits it.

10. Reviews, submissions and customer content

If you submit a review, photograph, message, feedback or other content, you retain ownership of your content and grant BCKYRD a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and use it to operate, support and promote the Website, products and relevant creator drop. The licence continues while the content is published and for reasonable archival, evidentiary and already-produced campaign uses after removal.

You must have the necessary rights and permissions for content you submit. It must be truthful, relevant and lawful and must not infringe intellectual property, privacy, publicity or other rights; contain confidential information, malware, hate, threats, obscenity or unlawful material; impersonate another person; or conceal a material incentive for the review.

We may moderate, refuse or remove content for a legitimate reason, including a legal complaint or breach of this section. We do not promise to publish every submission. Reviews reflect the author’s view and are not BCKYRD warranties.

11. Acceptable use

You must not use the Website to break the law; interfere with security or availability; introduce malicious code; obtain unauthorised access; collect another person’s data; spam or mislead; evade purchase limits; manipulate reviews, inventory or checkout; or use bots, agents or automated systems in a manner that disregards access controls, published machine-readable instructions or a reasonable request to stop.

We may apply proportionate technical controls, cancel abusive transactions or restrict access where reasonably necessary to protect customers, creators, inventory, systems or legal rights. We will not use a restriction to avoid an existing order obligation or statutory remedy.

12. Third-party services and links

Shopify, payment providers, identity or anti-fraud tools, carriers, social platforms and other service providers may supply parts of the Website or transaction. Their own terms may apply to services they provide directly. BCKYRD remains responsible for its own obligations as seller and for obligations that cannot lawfully be delegated.

Links or embeds may lead to third-party sites that we do not control. Review their terms and privacy notices before using them. A link is not an endorsement unless we expressly say so.

13. Privacy and cookies

Our Privacy Policy explains how BCKYRD and relevant providers collect, use, disclose, retain and protect personal data, and how you can exercise available choices. Cookies and similar technologies may be necessary for cart, account, checkout, security and site operation; analytics and advertising technologies are handled as described in the Privacy Policy and subject to available consent choices.

14. Website availability, corrections and changes

We aim to keep Website and product information accurate and available, but maintenance, connectivity, platform failure or a genuine error may interrupt access. We may correct an inaccuracy or update content. A correction after order acceptance will not reduce your confirmed order rights without your agreement, except where required by law or needed to address safety, fraud or an obvious error, in which case an appropriate refund or other remedy will be offered.

We may add, remove or change Website features and products prospectively. No creator collaboration, product or drop is promised until it is actually made available or confirmed by BCKYRD.

15. Suspension and termination

You may stop using the Website at any time. We may suspend or terminate an account or access for reasonable cause, including fraud, security risk, unlawful use or a material breach, and may provide notice where appropriate. Suspension does not cancel an accepted order, refund, grievance or statutory right unless separately resolved in accordance with these Terms and law.

Provisions concerning payment obligations, intellectual property, customer content, liability, disputes, records and any term that by nature should survive will continue after access ends.

16. Warranties and statutory protections

BCKYRD will supply products and perform its obligations with the standards required by applicable law and any express product warranty. Except for those obligations, the Website is provided on an as-available basis and we do not warrant uninterrupted access or that every informational page will always be error-free.

No wording in these Terms excludes responsibility for a defective product, deficient service, misleading representation, unfair trade practice, product-liability claim or other matter that cannot lawfully be excluded or restricted.

17. Liability

BCKYRD is responsible for direct loss that is a reasonably foreseeable result of our breach of these Terms or applicable law. We are not responsible for loss caused by your own unlawful conduct, inaccurate information, misuse, an independent third-party service outside our reasonable control, or an event addressed under section 18, except where law places responsibility on us.

If you use the Website for a commercial purpose, we are not liable for indirect or consequential business loss, loss of profit, revenue, goodwill, opportunity or data to the extent permitted by law. This exclusion does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of confidentiality or data-protection duties, product liability, or non-waivable consumer rights.

18. Events outside reasonable control

Neither party is liable for delay caused by an event beyond reasonable control, such as natural disaster, epidemic, war, civil disorder, government restriction, widespread carrier or utility failure, or platform outage, provided the affected party uses reasonable efforts to mitigate the impact. Your right to a refund or other mandatory remedy for non-delivery or prolonged delay remains unaffected.

19. Complaints, governing law and disputes

Contact customer care first with your order number and a clear description of the issue. Consumer and privacy grievances may be escalated to the Grievance Officer listed below. We will acknowledge a consumer grievance within 48 hours and aim to resolve it within one month, subject to the information and investigation reasonably required.

These Terms and purchases from BCKYRD are governed by the laws of India. Courts at Jaipur, Rajasthan will have jurisdiction, subject to any mandatory right to approach a Consumer Commission or another forum with jurisdiction under applicable law. Nothing here requires a consumer to waive a statutory complaint or redress mechanism.

A consumer may also use the National Consumer Helpline at consumerhelpline.gov.in or the consumer forum and e-filing mechanisms made available by the Government of India. This information does not limit any other remedy.

20. Electronic communications

You agree that order acknowledgements, invoices, shipping updates, policy notices and other transaction communications may be sent electronically to the email address, telephone number or account you provide. Electronic records and contracts are valid to the extent recognised by applicable law. Keep a copy of your order confirmation and these Terms.

21. Changes to these Terms

We may update these Terms prospectively to reflect operational, product, legal or technology changes. The current version and last-updated date will be posted on this page. A material change will be notified where required by law. The terms in effect when an order is accepted continue to govern that order unless a change is required by law or you agree otherwise.

22. General

If a provision is held unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not transfer an account or order obligation without our consent; BCKYRD may transfer its rights and obligations as part of a genuine restructuring or business transfer only where this does not reduce consumer rights and applicable law is followed.

These Terms, the Privacy Policy, applicable Exchange/Returns Policy, product-page disclosures and accepted order record constitute the agreement for the relevant use or purchase. They do not replace any separately signed agreement between BCKYRD and a creator, organisation, supplier or other business counterparty.

For an unresolved consumer grievance, legal complaint or privacy issue, address the communication to the Grievance Officer and include your name, contact details, order or account reference where relevant, the issue, the relief requested and supporting material. Do not send full payment-card credentials or government identity documents through ordinary email unless specifically and securely requested.
